TERMS OF SERVICE

By accessing, downloading, or using any mobile applications, games, or services provided by Tosh Labs (a brand of Tosh Labs Private Limited, hereinafter "the Company"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and the Company. If you do not agree to these terms, you must immediately cease use of all services and uninstall any related applications.

Our services are rated for users ages 9 and older. If you are under the age of 18, you represent that you have reviewed these terms with your parent or legal guardian and that they have consented to your use of the services. Safety Notice: We maintain a zero-tolerance policy for predatory behavior, harassment, or any activity that compromises the safety of our users. We reserve the right to report suspicious activity to relevant law enforcement authorities worldwide.

The services provide entertainment based on 'brainrot' culture—intentionally chaotic, absurd, and fast-paced content. This content is for entertainment purposes ONLY and does not constitute medical, psychological, or educational advice. The Company is not liable for any perceived 'mental rot,' decreased attention span, or other psychological effects claimed to result from the consumption of the services. Parents are encouraged to monitor screen time and content consumption.

You agree not to engage in: Reverse Engineering (decompiling apps), Automated Access (bots/scrapers), Cheating & Exploitation (unauthorized tools), Harmful Content (malware), and Impersonation (claiming affiliation with Tosh Labs).

All rights, title, and interest in and to the services, including the "Tosh Labs" brand, logos, game mechanics, artwork, soundtracks, and software, are and will remain the exclusive property of Tosh Labs Private Limited. No license is granted to you except for the limited, non-exclusive right to use the services for personal, non-commercial entertainment.

Anti-Harassment & Legal Shield: Tosh Labs maintains a strict zero-tolerance policy for harassment. Any form of harassment, threats, or abuse directed toward Tosh Labs directors, employees, contractors, or representatives—whether via support channels, social media, or in-person—will result in an immediate and permanent ban. We reserve the right to pursue criminal and civil legal action for defamatory statements, targeted harassment campaigns, or any action that puts our personnel at risk of physical or mental harm. Non-Interference: You agree not to interfere with the business operations of the Company or attempt to influence employees to violate Company policies or legal obligations.

Certain features or apps may require payment. All transactions are handled by third-party stores (Apple App Store, Google Play Store). We do not store your financial data. Subscription renewals are subject to the terms of the respective app store. Refunds: All digital purchases are final and non-refundable, except as required by law or the policies of the platform provider.

The Company reserves the right, without notice and in its sole discretion, to terminate your license to use the services and to block or prevent your future access to the services if you violate these Terms or for any other reason deemed necessary for the protection of the community or Company interests.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE SECURE, ERROR-FREE, OR FREE OF INTERRUPTIONS.

IN NO EVENT SHALL TOSH LABS, TOSH LABS PRIVATE LIMITED, OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY AND ITS PERSONNEL FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL BE LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

You agree to defend, indemnify, and hold harmless Tosh Labs Private Limited, its directors, and its employees from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the services, your violation of these Terms, or any harm caused to third parties through your account.

These Terms shall be governed by the laws of the jurisdiction where Tosh Labs Private Limited is incorporated. Any disputes shall be resolved exclusively in the competent courts of said jurisdiction. As our games are available worldwide, you are responsible for compliance with your local laws. The Company makes no representation that the services are appropriate for use in all global locations.
